Truck accident in Nashville causes pedestrian fatality

A tractor trailer accident on October 30th, in Nashville, Tennessee caused a pedestrian fatality, and sent a driver to the hospital. How does a truck hit a pedestrian? The truck’s headlights (if properly adjusted) should show the road ahead for 200’.

In this Nashville truck accident case, a 57-year-old man was walking in the left lane of the road when he was struck and killed by an oncoming truck.

We don’t know much about the driver or deceased pedestrian at this point, but it’s obvious that the truck driver didn’t see the pedestrian until it was too late to avoid the accident.  Did the pedestrian expect the truck to move over slightly? Was the pedestrian impaired?  We tend to blame the victim in our society, and perhaps the dead person here has some responsibility, but do they bear total responsibility?

Our sympathy to both families. Losing a loved one is hard to describe, and being responsible (even a little ) for the death of another is difficult pill to swallow. No one wins here,  but we all lose unless we can find a way to see that this doesn’t happen again.

Reports show that drivers whom are slightly distracted are 50% more likely to cause a fatal accident.

Could it have been that no matter what this Tennessee pedestrian was doing, that this Nashville driver just wasn’t paying enough attention?

Tennessee driver killed in speeding accident

A Tennessee man was killed in a single vehicle automobile accident while driving west on I-24 early on October 3rd. According to officials, his pickup truck rolled over on an interstate exit ramp in Davidson County after he had lost control. The truck flipped at least one time before it landed back upright. The driver was pronounced dead at the scene. The passenger riding with him was hospitalized with minor injuries. The exit ramp was closed for about three hours, while the emergency crews cleaned the debris. Our sympathies go out to the driver’s family and friends.

This is a tragedy to them and should be to all of us. The unfortunate tendency is to always blame the driver for any car wreck in Tennessee. Was this Tennessee car accident unavoidable? Were the injuries from this accident avoidable? Investigators believe that the driver may have been traveling at a high rate of speed, and we have no information to the contrary. Maybe that was the cause. Speed is a factor in many fatalities from car accidents in Tennessee and across the U.S. (for more information about speed as a factor in fatalities, click here).

Woman killed in a crash on I-40

A woman has been killed in a Nashville car accident on I-40. The woman was heading west on I-40 when she lost control of her car and slid from the right side of the interstate into the median guard rail. She was pronounced dead at the scene. Police officials say that she was not wearing her seat belt and was thrown from the driver seat to the back seat of the car, resulting in her fatal injuries. Officials also say that had she been wearing her seat belt, this could have been avoided.

According to The Naval Safety Center, Only 1% of passengers who were restrained were ejected from their seats during a car crash. Of those ejected, 73% were killed. And for the survivors of an automobile accident, medical costs are on average 50% more expensive for those who aren’t wearing seat belts.

The real question here is why did this lady lose control? It doesn’t appear that the Nashville Metro Police had any clues, but someone may have seen this happen.  If you were a witness to this event, contact our Nashville law office or the Nashville Metro Police with your information.

Tennessee Knee Injuries – Chondromalacia

Knee pain can be disabling, and if you have been in a Tennessee car accident, Tennessee motorcycle accident or injured on the job in Tennessee you may assume that some sort of surgery is going to be necessary to get things back to normal.

Among our Tennessee knee injury clients we have found that sometimes surgery can make a huge difference, but not always. Pain at the front of the knee may be caused by a softening of your knee cartilage, a condition called “chondromalacia” If your diagnosis is chondromalacia will surgery be the answer? Maybe not.

Recent research has shown that knee surgery for chondromalacia has limited effectiveness and shouldn’t be attempted unless the patient has 6 months of physical therapy without improvement.

Yaz side effects result in Tennessee lawsuits?

pill bottleYaz and Yasmin claims and lawsuits in Tennessee and across the U.S, have resulted from this drugs use for birth control. Yaz and Yasmin were marketed by Bayer as a safe contraceptive with minimal side effects. In 2008 they were over 17% of the contraceptive market. and over $1 billion in sales.

Studies from the British Medical Journal suggest that women who take these drugs are more than twice as likely to have complications as women who use other contraceptives. We now know that for some women the side effects of taking this medication can include stroke, heart attack, deep vein thrombosis, gall bladder problems, and blood clots.

As a result, over 100 lawsuits have been filed against Bayer (the manufacturer of Yaz and Yasmin) across the United States. For more information about this litigation, click here. Vioxx cases near end?

climberThe Vioxx litigation is nearing an end after review of more than 48,000 claims covered under a global settlement. Vioxx, manufactured by Merck, was a pain killer that came to be associated with heart attacks, strokes, and deaths. A $4.85 billion dollar settlement fund was created to pay the claims.  It now appears that the fund will pay approximately 60% of the claims, including over 3,000 death claims. Our firm has a number of Vioxx cases pending (as well as other pharmaceutical cases). For our clients the settlement cannot come too soon. It has been a long wait. For more information about processing of the Vioxx cases, click here.
